Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the YardSwaps marketplace. By using the Platform, you agree to comply with this policy. Violations may result in content removal, account suspension, or permanent ban.

1. Prohibited Listings

You may not list or sell:

• Stolen property or goods without clear title of ownership
• Counterfeit, replica, or knock-off equipment
• Equipment that has been recalled by the manufacturer or a government agency
• Hazardous materials, explosives, or controlled substances
• Weapons, firearms, or ammunition
• Items that violate any federal, state, or local law
• Equipment with removed, altered, or tampered safety labels or serial numbers
• Listings that are intentionally misleading about condition, specifications, or origin

2. Listing Standards

All listings must:

• Accurately describe the item including its condition, defects, and specifications
• Use real photos of the actual item being sold (no stock photos)
• List a genuine price (no bait-and-switch or “$1 — contact for price” listings)
• Be for items the seller currently possesses and has the legal right to sell
• Include relevant safety information for heavy, industrial, or commercial equipment

3. Prohibited Conduct

You may not:

• Fraud: Post fake listings, use fake reviews, or misrepresent yourself
• Harassment: Threaten, bully, stalk, or send unwanted messages to other users
• Discrimination: Refuse to transact based on race, gender, religion, national origin, sexual orientation, disability, or other protected characteristic
• Spam: Send unsolicited commercial messages or post duplicate listings
• Manipulation: Artificially inflate views, create fake accounts, or engage in shill bidding
• Circumvention: Attempt to bypass platform fees, rate limits, or security measures
• Data collection: Scrape, crawl, or data-mine the Platform without written permission
• Interference: Introduce malware, viruses, or other harmful code

4. Communication Standards

When messaging other users:

• Be respectful and professional
• Do not share other users’ personal information without consent
• Do not send spam, chain messages, or unsolicited advertising
• Payments happen off-platform: YardSwaps does not process, hold, or protect payments between buyers and sellers, so arrange payment directly with each other and follow the safety guidance in our Terms of Service (§3c) and Safety Disclaimer
• Report suspicious behavior using the in-app report function

5. Dealer Account Standards

Dealers must additionally:

• Maintain accurate and up-to-date business information
• Respond to buyer inquiries in a timely manner
• Honor listed prices and descriptions
• Comply with all applicable business licenses and regulations
• Not use dealer tools to create listings for items they do not possess

6. Reporting and Enforcement

If you encounter content or behavior that violates this policy, please report it using the in-app report button or email support@yardswaps.com.

We review all reports and may take the following actions:

• Warning: For minor first-time violations
• Content removal: Listings or messages that violate this policy
• Temporary suspension: Account access restricted for a set period
• Permanent ban: For severe or repeated violations

We reserve the right to take any action at our sole discretion to protect the safety and integrity of the Platform.

7. Changes

We may update this policy at any time. Continued use of the Platform after changes take effect constitutes acceptance.
