YardSwaps is a marketplace for industrial and commercial equipment, from fleet trucks and trailers to forklifts, generators, compressors, restaurant and warehouse equipment. This equipment can cause serious injury or death if improperly operated, maintained, or transported. Please read this disclaimer carefully.
1. No Inspection or Verification
YardSwaps does not inspect, test, verify, certify, or appraise any equipment listed on the Platform. Listings are created entirely by sellers. We make no representations about the accuracy of any listing, including condition, specifications, age, hours of operation, service history, or functionality. All equipment is sold “as-is” unless otherwise agreed between buyer and seller.
2. Buyer Responsibility
Before purchasing any equipment, buyers should:
• Inspect in person whenever possible — photos and descriptions are not substitutes for hands-on inspection
• Verify specifications against manufacturer documentation
• Check for recalls through the manufacturer or CPSC (Consumer Product Safety Commission)
• Review service history and request maintenance records
• Verify serial numbers to confirm the equipment is not stolen or encumbered
• Consult a qualified professional for equipment you are not experienced with
• Verify licensing requirements — some equipment requires specific licenses or permits to operate
3. Seller Responsibility
Sellers are solely responsible for:
• Accurately disclosing all known defects, damage, and safety issues
• Disclosing any modifications made to the original equipment
• Providing accurate specifications and condition descriptions
• Ensuring they have legal title and the right to sell the equipment
• Complying with all applicable laws regarding the sale of industrial or commercial equipment
• Not removing or altering safety labels, guards, or protective devices
4. Meeting up and paying safely
• Meet at the seller’s business, yard or a busy public place, in daylight.Bring a second person for heavy equipment, and tell someone where you’re going.
• Inspect and test-run the equipment. Check the hour meter, and match the serial number or VIN plate to the listing and the paperwork.
• For titled equipment such as trucks and trailers,see the title in the seller’s name, check for liens, and get a signed bill of sale.
• Pay when you have the equipment.Wire transfers, gift cards, crypto and payment apps can’t be reversed.
• Sellers: confirm payment has cleared before the equipment leaves,and keep the keys until you’re paid.
• Plan the load-out:the right trailer, straps and help. Don’t let anyone rush you.
• Keep the conversation on YardSwapsso there’s a record of what was agreed.
5. Common scams
Stop and walk away if someone asks for any of these:
• A deposit to hold equipment you haven’t seen.Never pay for something you haven’t inspected in person.
• Shipping agents, escrow services or “YardSwaps payment protection” links. YardSwaps deals are arranged for local pickup, and we never send shipping agents or escrow links in chat.
• Overpayment, fake payment screenshots, or a cashier’s check with a request to refund the difference.
• A verification code sent to your phone. Anyone asking for one is trying to take over your account.
• A price far below market from a seller who won’t meet or let you see the equipment run.
• Pressure to move the chat to text, email or another appbefore you’ve met.
If something feels off, stop and report the user from the conversation.
6. Equipment Operation Safety
Industrial and commercial equipment is inherently dangerous. Users of equipment purchased through YardSwaps must:
• Read and follow all manufacturer safety guidelines and operator manuals
• Ensure all operators are properly trained and, where required, certified
• Use appropriate personal protective equipment (PPE) at all times
• Comply with OSHA regulations and all applicable workplace safety standards
• Never operate equipment that is damaged, defective, or missing safety guards
• Follow all local, state, and federal regulations for equipment operation and transport
7. High-Pressure Equipment Warning
Pressure washers, hydro jetters, and similar high-pressure equipment pose specific hazards including injection injuries, eye injuries, hearing damage, and electrical hazards. These injuries can be severe and life-threatening. Never point high-pressure equipment at people, and always maintain safe operating distances.
8. Transportation and Rigging
Heavy equipment requires proper transportation and rigging. Buyers are responsible for arranging safe transport including appropriate trailers, tie-downs, and rigging equipment. Overloaded or improperly secured equipment during transport can cause accidents and fatalities. Consult a qualified rigger for heavy lifts.
9. Limitation of Liability
YARDSWAPS EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM THE USE, MISUSE, OR INABILITY TO USE ANY EQUIPMENT LISTED ON OR PURCHASED THROUGH THE PLATFORM. This includes but is not limited to claims based on equipment defects, inaccurate listings, failure to disclose defects, improper operation, or improper transport. By using the Platform, you acknowledge and accept these risks.
10. No Warranties
YardSwaps makes no warranties, express or implied, regarding any equipment listed on the Platform, including warranties of merchantability, fitness for a particular purpose, safety, or compliance with any standard or regulation.
11. Report Safety Concerns
If you encounter equipment that appears to have been recalled, is missing critical safety components, or poses an immediate danger, please report it to us immediately at safety@yardswaps.com or use the in-app report function. To report a person or a message, use Report in the conversation.
